F10 transmission problem?

Hello all. new to the forum, and need some guidance/help with a problem I'm having regarding my '13 M5.
I'm not sure if it could be a transmission issue, but it seems that at times, while I'm stopped, the car does not automatically downshift into 1st gear, and stays in second. Upon accelerating, the car seems sluggish at first. I can switch into manual and the car will down shift into first, and be fine.
I've been told by my SA several times that since they can't "reproduce the event", and since there are no fault codes, there isn't anything they can do. I've actually been told that it might be normal. Not buying that, but I'm not as technically inclined as I'd like to be.

I've had the car reprogrammed twice with no success.

any thoughts on what the problem might be (if there is an issue)? and are any other owners experiencing similar issues?

Greatly appreciate any info from the forum.

Not sure in the F10 but this was standard in the E60 for D1. When the car is warm enough and left in D1, the drives off in second gear to make it less jerky. People even reported worn off clutches when driving lots of city traffic in D1 because the clutch slips when driving off in second gear but you won't notice that. It didn't do this in D2 and up any more. The F10 only has three D modes and I never use D anyways so I couldn't tell if this happens in D2 as well but if people see this, it should be the case. Anyways, this is normal and supposed to be a comfort feature.
