Unhappy Gear box failure on M5 after 69K miles

I bought an 06 plate M5 last week with 69000 on the clock and paid £22K. 5 days and 300 miles later, the gear box dies on me. currently its waiting to go to BMW for diagnostics testing but the garage its currently at says initial thoughts are that 'its eating itself'!!! Any thoughts on whether this is acceptable at 69k miles or should we be sending the car back to the dealer in anticipation of a whole host of problems based on whatever it is that cause this gear box failure?? Any thoughts would be appreciated - its my first BMW
