I have been following this since the start and am absolutely disgusted at what has happened. I thought that perhaps there could be another side to the story but on the facts placed before us on this discussion board I find it hard to imagine what defence the dealer will offer.

There is a clear distinction here between accidents that may occur during the normal course of the dealer's business and an incident such as this that appears to have arisen from wilful negligence and excessive risk-taking with the OP's property. To those posters that made the analogy of being run into by a joyrider or uninsured driver whilst on the public road, this is not a fair comparison. One assumes that this is a risk when driving on the public road but one does not expect that a dealer would deliberately abuse a vehicle to the end that it is written off.

Although I am in the UK where we are not so litigation trigger-happy I think that the OP has every justification to take this dealer to court and sue for a considerable sum.

It's also now (edit: one of) the top search result(s) from Google for the most basic string "Autobahn BMW".

Although obviously different, it can be just as powerful as a billboard.

Edit: The reason Google is showing me this site as the first search result is because I have Google desktop and Google Integration is on. Therefore when I search, it also looks on my computer for similar results. Sorry for the misdirection.

If it's #1 now they are screwed! It is more powerful and not much they can do to "sue" anyone like you could on a billboard!

i just typed Autobahn BMW into Google. Its not first, its like at the bottom of the page. Maybe it got bumped?

I totally agree with T-Bone...only thing I would add to the SUIT is that the 'Test Drive' was not necessary in any way as this was just a normal maintenance visit. This helps provide some separation of the act of the 'Test Drive' and 'Maintenance (e.g. what you brought the car in for.)

I am also surprised that we have not seen anytype of statement or story from the dealer itself. Being slient does not realyl help their situation, I am eager to hear their side of the story and what they see is acceptable behaviour to a BMW M customer.
