I think everyone here already know's what the outcome will be. Crash dealerships insurance will payout what it cost to repair the car or total the car, that's it and nothing more. Like it or not, that's what you get insurance for, to repair a wrong not to enrich.

More signs of a corporate culture gone wrong

MyE28.com: BMW E28 5-series Resource - View topic - At least the dealership is owning up....=

It may not be an M5. It may not have been a joyride.

It was still wrong and it never should have happened.

The lack of caring at higher levels has always bothered me. BMW AG doesn't seem to care much what BMW NA does. BMW NA doesn't seem to care much what the dealerships do. It starts at the top.

They are no different than most corporations now. They want to protect the bottom line, grow revenue, regardless if that means cutting services, people or the quality of the product.

From my experience, the claimant needs to sign a release at the end

When my own insurance company was the one paying me, they did everything to make it as painless and fair as possible because they wanted to keep my business.
If you're not happy with what their proposed resolution is you do not have to sign and then you can take them to court. In my experience, they will try to screw you if you let them. BUT, if you know that you have the upper hand, you can force them to either completely return the car to like new state and also provide with $$$ for diminished value or total the car.
