At this point in time I've lost complete confidence and respect for this dealer. The proper thing to have done immediately after the incident is to try and make the customer happy. Since he didn't, it proves to me that they are not customer satisfaction driven, as they should be. The current market conditions could potentially hurt this dealer, however, he may feel confident that this was a small enough issue that he can sweep under the rug and hopefully it will go away. I truly believe he's made a terrible mistake and that this issue will haunt him in the future. He may also be one of these owners that doesn't believe in the power of the internet and media in general. If that's the case then shame on him, because in real life you either pay now or pay big latter on. Obviously he chose the latter. But I agree with all of you that this matter needs to be settled ASAP for the benefit of both parties involved.

Good point. I might use them if the OP seemed satisfied. On the one hand they would have done the right thing. But on the other I would be wonder if they only did because of the bad press, public pressure, etc. I would be interested to know why they decided to change their course of action.

Tell you what though. I would be far more likely to use them, than if they play this out like they are now. People have long memories when it comes to outright bad stuff like this.

It's pretty obvious this dealer just does not get it. As is true in so many human dealings especially in business interactions it takes just one "ah sh*t" to override a whole bunch of "attaboys". This dealer could have turned this whole event into a positive for his dealership by doing the right thing up front. Full disclosure, made the owner more than whole and the OP would have come on here with a sad tale but with happy ending and probably sang the dealerships praises. The impact would certainly been less dramatic but still on the positive side but oh how much less the negative side would have been. Now there is no hope to recover as has aleady been stated. Anything the OP gets out of this will have been through his hard sweat and tears.

I know I go out of my way to sing the praises of my dealer when they do good. I always give them a chance to make right via "goodwill" and they have come through everytime. I, in turn, make sure they know I have posted a positive remark on their actions. But I also forewarn them that the opposite could happen and I do think it is persuasive as they hold public opinion (or perception) in high regard. It is something I think many members may use, but maybe more should make sure their dealer (CA, SA, management, etc) know you are on major enthusiest forum(s) and you do or can sing their praises to a wide audience. No need to really tell them you'll do the opposite if they screw you over as it is pretty well implied without saying.

Only after this dealership treated the OP so badly do I oh so hope his lawyer can squeeze the dealership or their insurance company out of more than making him just whole.

The bottom line is if they satisfy the OP maybe I would consider using them, with caution. I want a dealership that works for me with respect and professionalism and owns up to their mistakes, I would not settle for anything less.

As McarRcr07 has stated, the opinions about this dealership has been a foregone conclusion.
If you were the dealership, what benefit is there to make the OP whole at this point? It's not going to change anyone's minds about them.
The course of action has been determined...the dealership is dug in and not going to give an inch...

again and hopefully not again...LOL.....the ship has sailed for the dealer.....yes the OP wants a just resolution...as he is entitled to but I doubt that even he would use them again if they went out and got him a "twin" of his M5.
someone touched on this waayy back maybe on page 18...LOL.....that
errors occur....even those as egregious as this one.....it is how you (dealer) handle them is what counts.....and in this case I believe the vast majority are in agreement that things went from bad to worse to debacle in no time flat.....had things been handled differently from the start then this thread is not even half as long with no ill feelings or "pitch-fork" mentality towards the dealership.
I am in a service industry and our goal is to make 100% of our clients happy 100% of the time.....might sound pollyanna but especially in today's economy this goes a long way. We make mistakes....it happens....but we correct them no matter how painful it may $$$$ to my business....this goes a long way with people trust me.

To be honest I think it was a mistake to ban bimmer1guy. I think he was a complete twat and out of order, but freedom of speach and all that. I actually think that banning could potentially harm the sites reputaion as a site that considers the opinions of all. Even if his opinion was wrong
