Very glad OP got what he was owed, and very sorry he had to go to court to get it. No one comes out ahead other than the lawyers (I would guess 75% or more of all money dispersed as a result of this case went to attorneys), but at least the stealership was punished by having to pay all the costs resulting from them not making good on their error in the first place.

CONGRATULATIONS!
Had Autobahn simply just gave Tommy a new M5 at the time of the accident, they would have saved alot of money, not to mention all the positive publicity.
I really hope that BMWNA is watching this closely and take some sort of punitive action against Autobahn...

The jury's decision is that Tommy get's about 37% of the $159,641.05 award. Seems upside down, but if that's what it takes to hire a good lawyer and stand up to a big business that doesn't want to be responsible for the negligent actions of their employees, then I'm for it.

Sadly, Autobahn may never directly feel this punishment because their insurance will likely pay for this case. Maybe their premiums might go up a little? I can only hope that they learn from this experience and mend their policies so that 1) additional steps are taken so that an employee never negligently wrecks a customer's car again, and 2) they are more honest with the customer about what happened and offer to pay for the repairs, even if it's at a different shop.

My sentiments exactly, well expressed.
Doing the right thing from the get-go would have turned a bad event into a PR victory, saving money in this case and saving future lost car sales. I hope other businesses learn from this...
