Good luck Tommy. It's sad that this even needs to be stated, but the first thing a dealership ought to tell their employees is no joyriding, whether it be a car on lot and especially a customer's car. Pacific BMW in Glendale, Calif. is getting press for this video of a "test drive" of new car that was later sold to a customer for over sticker.

I wonder if it would be good policy to have dealerships place a big orange sign on the back window of customer's cars that say "This car is in service at XYZ dealership." to get their employees to respect a customer's car while on necessary test drives.

Presuming that the court date does not get postponed, I wonder if there will be the usual sudden last minute magical settlement from the dealership/lawyers after months of nothing. And then I suspect Tommy won't be able to reveal the details of the outcome.

Not likely. I really don't think they even care if they lose.

Today, of all days, it's important to remember all of the injustices and stick together.

Tommy, we are still very much here for you and wish you all the best. Whether they get a postponement or not, I have faith that justice will ultimately be served.....in your favor. The legal wrangling we have to put up with in our country is still better than the alternative.....as unjust as it seems. Keep the faith and we'll be here with you.

i remember when i was working at a honda dealership, even the managers were abusing the customers cars, they indeed didnt care! from my experience in working a three dealerships, work ethics in car dealerships are never there!

Excellent idea and 'incude call XYZ if my driving is not up to standard'.

I just stick my GPS tracker in the car (hidden) but also have another GPS video tracker they are told about to monitor driving. I get them to sign a disclaimer that they now there is surveilence equipment in the car, that way if they tamper with the obvious video tracker so it doesn't record I have a back up!!

Its a sorry world where we have to do this. I know form personal experience of having my M5 tortured by a UK BMW dealer... never again or if they do I will have the proof not just the empty tank of gas, warped brakes and lost rubber from the tyres

All dealers from all marques should get smart on this!

They will if you get a judgment against them!

One year from claim to trial is quick in our bogged down system. I can't imagine this fact set will ever actually get to a jury. Don't be shocked if settlement talks begin after jury selection and before or after Opening Statement, but before witnesses are put on.

About the only way they won't care is if they have insurance and have already met their deductible. Even then, a claim that is paid will affect future premiums.

Even then their insurers will want to settle. I can't imagine they want this to see a jury and take their chances. You never know when one is going to come back and slap you with a million in punitive damages.
