I happen to listen to an NPR segment today on this, the NYT journalist who wrote the original article was on the program, they talked about the Google changes so...
bottom line if you want to find the truth about a merchant in Google you need to add COMPLAINT in the search query

It's number one on google for me

When I simply type "autobahn bmw" (quotation marks added in this posting for clarity, not used in search) into google it comes back as the top hit, above the stealerships official links. No reason to type the word complaint. This is on a Mac using Safari and/or Firefox.

Its n umber fourth for me on "autobahn bmw". However when you have writed autobahn bmw Google immideatly suggests "autobahn bmw reviews" where Yelp is number one with reviews of this very post present in some or many reviews. Numer #2 is their own SEO-optimized "reviews". This thread is number 5.

Thought I'd update you guys on the Gallardo but I've been beaten to it.

While I can't comment about my case in particular I can say the following and you guys can connect the dots.

Public pressure is everything. If you were to register domain names very similar to the dealership's and then get the amount of hits there that this thread has so that it shows up as #1 when people google the dealer's name and go to that site thinking it's the official site, that will scare the dealer closer to action.

Dealers are often incredibly stubborn and will continue to try to "win" even if the damage to their reputation would be far less (and cost them less) if they just compensated you. They will not lift a finger until they are fully paid back by their insurance. They will refuse to pay a dime out of pocket unless you can turn things into a very public disaster.

Get support from competing dealerships, set up websites (domains are cheap), get on local forums. People love to hate dealerships. They will call them, harrass them, email them, spread the word on facebook, etc. The story of the accident is too old to be picked up by local media, but if you start a shitstorm then there's a whole new consumer activism story that they WILL want to run. Be factual but be aggressive. If they're as bad as some dealers they'll try to countersue you for slander. Media will EAT THIS UP and reinvigorate your cause and backfire on them hugely.

Remember that their sales staff are paid on commission. If you damage their reputation to where it's twice as hard for them to sell a car they will jump ship and go elsewhere.

I guarantee you that with a few hundred dollars, some of your time, and the support of the people on this forum alone you can bring that dealership to its knees.

12 hours of public attention from a forum post mentioning intent to bring online a few websites, and the outrage of the fellow users, achieved FAR more than 7 weeks of lawyers.
