As others have said this is all legal speak.
about the only point they might win is evidence of his milatary service as it might prejuduce the jury. If Tommy's lawyer has not taken this case on a contingency basis may I suggest that the collection for the bill board be used for his legal expenses.

My favorite parts of their response were the multiple times they referenced the 5th, 6th, 8th, and 14th amendments to the U.S. Constitution.

I'm curious WHOSE attorney's these are???....are these guys with Autobahn's Insurance carrier???...or did they retain them themselves??
and yes it does make a difference...lol
either way...boilerplate response....as many have said....how long this drags out is really up to the backlog of civil cases in his area of Texas....
frankly though seeing that Autobahn has behaved in a reprehensible fashion...I guess they figure they may as well play it out to the bitter end...because even if they did an about face...damage is done.
Best of Luck to the OP

BMW NA writes back

This is BMWNA's answer to my letter. Not very impressive, but expected nonetheless.

>Thank you for contacting BMW of North America, LLC.

>We have reviewed the situation and determined that this is neither a product quality or warranty-related concern. Therefore, this matter is >solely between the individual customer and the BMW center.

>Kind regards,

Well, to be honesty that is the case.

That said, this might hurt the BMW brand which includes BMW NA since it is so close to the core consumers of BMW and the most passionate: the BMW M owners.

Maybe someone should tell them Customer Relations go beyond product quality and warranty issues. Such a cold and flagrant dismissal of customer satisfaction. I'm apalled.

Makes you feel all warm and fuzzy inside about what you are driving doesn't it. I just can't imagine ever driving a BMW again. It sucks because I really enjoyed driving their cars.

It is now time for you to cruise into Autobahn with your shiny $700 a month Corolla and park it through the double glass doors of the dealership. When they ask for insurance information, you will just tell them that the door handle is the most expensive part of the door you just shattered and you will get if fixed up for them in a jiffy. Just needs a door handle and some glue and those doors will be good as new! Not to worry...then ask them for a service loaner as your rental car just was not cutting it for the payment you are making on the M5 they totalled. Treat them the way you have been treated and see how they react.

Now, BMWNA is NOT at fault here beyond allowing Autobahn to represent them - I do not disagree with their tact through this storm - as I stated before - as they have no means to recover the cost of the car they promised you. Only Autobahn has that ability. I cannot for the life of me figure out why BMWNA made the offer they did in the first place.

+1. They don't actually deny the events. This is all procedural litigation crap that is standard course in our inane system.
