BMW Australia, despite not being obliged to, when pressed by owners repaired any cracked subframe floor on E46 M3's (including my own). On the back of the US class action. A brands reputation makes up much of its marketability. I wouldn't be too quick to dismiss this as the M5 is one of the brands hero's.

Should BMW lost, we will see similar lawsuit to Italian cars (Ferrari, Lambo, Maserati), BBC (Jaguars, Land Rover, Aston Martin, Bentley, RR), and Korean Kia/Hyundai. Many/most of them will go bankrupt.

3. Modification (mine may failed due to the Muffler and Charcoal Filter deletes).
4. Track history.
5. Driving habits.
6. How many and type (rental or corporate) of owners.

The S85 lawsuit is an arduous and very difficult to execute! So it will embolden to sue the other mentioned brands, since it will be a cakewalk.

On a business level, I don't think BMW is too concerned about possible rod bearing failure in two of its high performance motors (S65, S85). Not to say a class action doesn't have merit, but suits like this to major manufacturers are just considered nuisance lawsuits. Look at this GM ignition switch suit where people have been killed. They've been blowing it off for years and they aren't going anywhere.

For lawsuit technicality, I see negligible probability of success for this lawsuit, but BMW may just issue a recall as a PR propaganda, because they may sell more M cars!

Pity it can't be a worldwide class action. Although the US based E46 subframe CA seemed to percolate down here also. Fingers crossed.

As I had stated before, technically this would be an impossible case to present. The only hope is the non-technical cause of BMW failure to warn customers the use of heavy 10W60 oil. They must had instructed all buyers to warm the cars properly before high revving driving. The engine is an F1 racing based that must be warmed properly.

This engine sounds like it's going to blow the F*&K UP when cold anyway, so it gets warmed up stupid-slowly every time.

1. Statistical failure from all produced cars. - Everyone knows this is a issue and it happens in all vehicle years, all mileage, all scenarios (dealer maintained/home maintained/small mechanic maintained, etc. Even oline retailers are selling kits to do the rod bearing job as preventative maintenance. Just because bmw NA or stealerships don't want to admit it doesn't mean it isn't happening, and perhaps a good law firm can demand bmw to explain why it is happening to so many vehicles where as in a different bmw engine it doesn't happen. It doesn't take a genious to put two and two together.
2. BMW dealer maintenance record (Independent dealer maintenance is unacceptable). - Independant dealer or Independant DIY ? Either or - every other engine other than s85 or s65 doesn't have this problem - dealer maintained or DIY maintained. How can S85/S65 owners do improper DIY maintenance on these engines, but do it properly on any other BMW engine. I myself have 4 differnet bmws - always maintained on my own. Only the s85 has this problem.
3. Modification (mine may failed due to the Muffler and Charcoal Filter deletes). Your rod bearings failed due to charcoal filter delete - really... Meanwhile mine has charcoal filter and oem mufflers intact, and rod bearings failed also. Common sense: Perhaps rod bearing tolerance is just too tight?
4. Track history. I don't track. If I had good rod bearings then maybe I would try one day. Apparently it's a lot of fun. Oh but wait, I can't, my rod bearings are ****.
5. Driving habits. I have been a BMW owner, driver, and promoter to friends and family for 14 years now. Quite the run, but guess what, I finally got the best bmw ever, the M5 (almost 2 years ago) and guess what - this is going to be the LAST bmw purchase used/brand new/whatever if bmw doesn't own up to their mistake I will not forgive them. I will go switch over to the Japanese or Domestic counterpart.
6. How many and type (rental or corporate) of owners. Who cares!?! some vehicles on the road bmw included have over 300,000 miles and never had a single rod bearing issue.

The S85 lawsuit is an arduous and very difficult to execute! So it will embolden to sue the other mentioned brands, since it will be a cakewalk. - I think there just wasn't enough s85s sold in the first place for a law firm to make money on the case.

Fyi i frequently get loan cars brand new when ours are in for repairs

Almost every loan bmw i drive has some sort of problem, random warnings, radio reception poor, tire pressure monitor issues, scraping noises from jammed rocks, rattles and squeeks

I think my wifes car ill get an audi or Mercedes next

I might get another bmw but it would have to be an immaculate track ready supercharged m3 e92 haha
