With an M3 on order, has BMW officially and realistically solved the rod bearing issue once and for all? Or is this still a potential issue?

They had two major recalls in this area where they replaced different parts. I imagine that new cars have been built to this spec for over a year. All indications are that it is fully resolved.

My brother is a service writer and yes the problem has been solved. 05's are fine!

Is BMW still giving the CPO-style 6yr/100k mi warranty to buyers of new E46 M3s, or was that only for the years affected (e.g., where some of the cars had problems) ?

The 6yr 100k mile extended warranty was only for the affected model years under the rod bearing recall, and it applied only to the engine, IIRC. 2004 and later years do not have the extended warranty since the engines in those model years incorporated the corrected parts in production.
