X5 Cut-out problem

Has anyone experienced the following problem with an X5;

The car will not respond to the key when trying to access the car, i.e. unlocking doors, the car itself is as if there is no electricity, i.e. no dash display, hazards, lights. There is no click from a soleniod, absolutely nothing. Then, after perhaps 20-30 mins, the car will respond as if nothing has happened.

The car is back with BMW for their second attempt but they seem pretty clueless here in Spain.

Here's our story...

We took delivery of a 2008 X5 35sd (full options) in October and it's been sitting in the workshop since December!

We have a lawyer involved after paying 89,500 EUR for the car... it spends more time in the workshop than our own garage.

I think the current X5 is WAY OVERVALUED! It's worth half of what they ask and I really do wonder what BMW are trying to do here.
