Just spoke to your dealer and they said "they will do whatever they can to get the credit, but there is no guarantee" He tried to sell me the car based on the above statement, but when I said I need it to be part of the deal, he said no one can commit because BMW has not confirmed any extention of the plan. Frustrating. I'd love to take advantage, but my dealer is giving me the same story. I was hoping to use your dealer as leverage, but no such luck. The reason it's an issue for me is my lease expires in January, and in order for it to make sense to order the car now, I would need the $4500 to offset the extra payments.

Order the car. If it comes in and they say "Sorry, no $4500" you say "sorry, no sale!!!!"
There is no such thing as a binding sales contract (AFAIK)...pay a 'deposit' if you must, just put it on a credit card... don't sign anything that legally binds you! So simple.
The car isn't 'sold' until it arrives and you drive it off the lot. This is why car dealers are so desperate to get you behind the wheel and off the lot!

PS There is more to this issue.... dealers must place a 'confirmed order' by 8/31. There are only so many 'production slots', so if they take your order, and place it, but do not get a 'slot' you may not get the $4500. This is my current understanding. So they are telling you a partial truth. BMW would need to extend the deal to get it on a 2010 that YOU order today, but that due to production slot limits does not get accepted by BMW until after 8/31. Make sense? Perhaps you need to be more pointed in your queries..."Do you have an X5d allocation that I can order by 8/31?"
Oddly enough, we just bought ourselves a new X5 diesel!
Morristown BMW kept telling us that they may have trouble getting an allocation to qualify, and also had a hard time budging on a final price. They did say that if they ordered a car that didn't qualify for the $4500, they will return the deposit and not sell themselves.
We went over the Paul Miller BMW, and they guaranteed us an allocation and finally made a deal for $1000 over invoice.
Real world mileage will be in the low 20's...I wonder if an ECU tune and free flowing exhaust will improve the mileage as much as it does on other turbo diesels. I'd imagine so...hopefully someone is working on a tuning package for the X5 diesel now...I bet it'll sell VERY well.
With the emissions set up and clean exhaust technology, would exhaust swap be a possibility? I was always just expecting ECU tunes as the main mod for the 35d.

Very cool. I went White with Saddle brown Interior. Love the saddle and couldn't agree with you more about the carpets and lower trim being black. Once you've driven her for a while, I'd like to know what kind of mileage your getting.
