        Dealer or Individual????

well i'm finally getting ready to pull the trigger on an m5, and the following two on ebay have caught my eyes, both are in driving distance:
        1. eBay Motors: BMW : M5 (item 370079744503 end time Aug-31-08 17:28:50 PDT)

        2. eBay Motors: BMW : M5 (item 380055966450 end time Sep-06-08 14:29:48 PDT)

anyways, number 1. is from an local dealer(individual) and 2. from the actual BMW dealership.
Both are same year 2006 same color BLACK, but number 2. from the BMW dealership is missing ventilated seats, cost about $5000 more and has about 8000 more miles on it.
When i called the local dealer (individual) number 1. he said the car is at bmw getting an oil change and brake service, since its free and covered under warranty. So i have not test drove or seen it yet!
So i called the BMW dealership told them about the vehicle and how much less it costs at local dealership (individual) number 1. and so on, and right off the back the BMW dealership SA tells me that those other dealers (non BMW dealers) only buy wrecked cars and don't check them with paint meters, but every car at BMW gets checked with a paint meter. So i tell him that i have checked the vin and its clear as far as i can see! But he insists that they (local dealer individual) could have taken it anywhere for service, without reporting it.

        My questions are as follow:
Does anyone have access to check (in this case double check it, i couldn't find anything negative) the vin from number 1. (individual):WBSNB93526B584354
if it clears, it should obviously be a much better deal right? or no?

Also if i do go with the individual dealer, is the car completly covered if something breaks on it, since it still has the original factory warranty on it. 50K or 4 years. Or can BMW bitch about something.

SINCE THIS IS AN INDIVIDUAL CASE, I DID NOT PERFORM A SEARCH! LOL
        QUICK RESPONSES ARE WELCOME.
        THANK YOU IN ADVANCE
