Advice on Non Disclosure of Purchase of a Trade Assist (Buy Back) car?

I recently found out that my M5 that was presented as a clean title car is in reality a manufacturer buyback vehicle.

I have been trying to contact the dealer but they are not returning my calls.
According to Maryland law, there should have been disclosure to me at the time of purchase which would have caused me to walk away from the deal.

Any idea what my recourse is here?

Did you buy the car in MD? Where?

I would be ripshit and drive the car right back to the dealer. If MD law requires disclosure and they did not disclose it - you are all set. Better check the fine print in the contract.

+1

please go read all your paperwork (that should be fun!)

Make sure its not in there anywhere before you make your next move.

I looked over my paperwork and confirmed there is no mention of the history of the car as a matter of fact it was clearly represented as a clean title car.

In any case, according to the law, any contractual stipulations are not affected by the law - they misrepresented the car to me at the time of purchase and I only just found out about it yesterday.

What a week

They get around the law by simply taking it back on "trade" in exchange towards another vehicle. It would have to be bought back under a lemon law claim for disclosure at resale. Some people simply dont like the SMG and return the vehicle to the dealer after a few thousand miles for a different vehicle. A good dealership will do this for their good customers. The flip side is a problem vehicle which a good dealership will take back without a fight and get the customer into another vehicle. It still sounds like mis-representation either way when they sell the vehicle I would contact BMWNA and see what they will do. I believe the same scenario happened to a guy here in CT and BMW traded him up even into a new 08.
