Well after having to take my beast in for the recall it turns out the update fried my dme so bmw is replacing it. Good thing is that with the new recall my service rep (friend) told me I will have a new warranty with the recall and troubles I have had. Although bmw gave me a mazda 3 rental, the weekend is when the beast comes out and i'm already missing it .
For those that need to get the recall done, try to avoid it at all costs or have your dealer "say" it was done if you know them well enough.

The problem with that is that it won't communicate with certain smog check equipment and then fail. Depending on when that happens, the records will show that the recall has been done so fixing it to pass will be on your own nickel.

"Is it the sounds that make a BMW a BMW? A BMW is designed to be heard, felt, experienced. So our engines sing. Our steering talks back. And we insist on offering manual transmissions in nearly all our models for drivers who crave them. The result is an almost telepathic oneness with the car. Just as surely as you can hear a BMW, a BMW hears you."
There have been known issues that during programming either the GT1 or Progman computer will lock up thus "frying" or losing all info. for the M5 DME. In which case a new one will be installed.
i've heard the stock dme will only take so many 'reflashes', anyone know if this is true?
I still need to get this done, first attempt at asking the dealer to 'do it but not do it' was declined (though i didn't ask the right person). I have a feeling my lastest dinan software already incorporated the fix, as my car passed smog at the corner smog station.

Yes it's true. On the GT1 for example it will tell you that the control unit has X amount of times to be reflashed. I think the limit is 13 times.

so i wonder what happens if i go in and i'm at the limit? bmw has to give me a new dme because of the recall? (really don't know how many times my car has been flashed, but it's been several).

I had the emission recall on my S2 done by BMW of Greenwich. They're also a Dinan dealer & reinstalled the S2 software after doing the warranty work. It was itemized on the bill. No charge for any of this.

Jon@TheMShop,
That's good information. If you do get a replacement, I wonder if you have to have the dealer install it for you. I noticed that on mine, it had sticker with the VIN on it. The thought occured to me that when you unlock your computer for the MAFS test you need your VIN.

i'd imagine this is a dealer only (or a shop with gt1 or similar) issue to code/program the dme.
