HELP! How To Purchase this Car (Cashier's Check, Hold, Out of State, etc.)

hey ok i was looking at buying a used car and i finally found one but the dealer said they can't hold used cars only new cars. i talked to them and told them i was serious about buying but could only come up this weekend.

the price and pictures and condition/description of the vehicle all seem good and i have the money to purchase the car so after asking permission he told me that i could fax him a copy of a cashier's check from my account which would show i was serious about buying and then they would hold it til this weekend.

does that sound ok? he said to fax a copy of the check for the total price plus processing fee and i said well i don't want to have that much out of my account for a week how about i do half and just fax a copy of an even number about half the amount and he reluctantly said ok.

can this burn me in any way? i understand that the dealer would sell the car to the person who comes in and offers the price they want and they wouldn't give allegiance to me b/c if i was a casual looker that means it'd sit on the lot an extra week. however, i personally know that i AM a serious buyer and will buy the car on saturday unless there is something grossly wrong with it or the condition is not as stated.

the thing i'm worried about is faxing the cashier's check copy and then them being like well this is the price you faxed us so you can't go less plus there is this fee and that fee and it quickly goes out of hand - that's why i thought me doing an even 40-50 percent of the amount solved that since hey if they sell the car to me for half price great. he told me that if i came up here i could rip up the check if not happy and its not binding blah blah but i was posting on here to make sure this is a good idea. i don't want to send a fax, get up there and find out there are huge problems with the car, and then them say well its either pay us or lose half the value of the car b/c we will cash this copy/take it to court. what do you think about this whole situation?

also, since i'm out of state, they told me that they could register the car for me in NC (where i live) and i'd just pay them the dmv fees and then could drive it here with the temp tags but then i asked him if i could register and he was like um yeah i guess you can buy it from us and we'll give u a temp tag plate and then you can register it yourself and pay the necessary taxes and fees in NC (but i'm not sure if that's legal or would be a problem)

how does all this sound to you? am i missing something or walking into a nightmare or what? for instance, is there a catch like i need to pay that state's taxes too or that i would need paperwork from my state NC before i go up or that i can't go up on Saturday b/c some government office I'd need to go to is closed on Saturday? What are the problems w/ the cashier's check thing and what should I say when I fax it to them or what should I have them fax back?

I was going to say on the cover sheet that this was a sum to show my intent on purchasing the vehicle given good condition and working parts, etc. but i wasn't going to say the price or anything like that - anything else i should add or anything to cover my butt?

Ok after faxing that i was going to call them and have them fax me a sheet confirming that they will hold the car til saturday - what should I have them say on it - should they say odometer reading or price or that they will hold it til saturday but its not contractually binding or what?


i'm not a lawyer and this is my first car purchase, let alone an out of state purchase! so any advice is GREATLY appreciated!!!!!

Hey sounds a bit odd to me.

I spent a long time searching for an M5. When I found one, I also wasn't able to get down to the dealer for a few days.

I already new what I wanted as far as colour combo and spec so I knew I was happy to buy. I asked the dealer to fax over the car spec and details and to confirm several things such as exact condition of the car, scratches, stone chips, wear to leather, service history etc.
The dealer added to the fax that they would hold the car for me if I provided a Credit Card deposit. They stated that the deposit which was refunable if the car was not as described ( i.e. if the dealer told me that the alloys were in perfect condition and my inspection showed they had curb rash etc ).

You have to put some trust in each other, but all this faxing of Cashier's cheques seems a bit mad to me. Reminds me of those stories where the dealer snubs some guy because he thinks he's a time waster

i don't see why they would think i was wasting time - i was very straightforward if they hold it til saturday and its as described, its sold.

i asked about deposit and the guy was like we don't hold cars and then i called back and talked to a different salesman to check and it is a dealer policy with them. anyway, he said i could do the cashier's check thing and they'd hold it so that's what i did - i mean i'm not binded at all by it i don't tihnk and they aren't binded at all i guess which sux for me but its just good faith that i will come up on saturday which i know i will but they don't and that they will actually not sell the car.

i'm kinda worried b/c my salesman hasn't come in yet (he's expected in afternoon) but if someone buys it today i'll be pissed. hey if it doesn't work it doesn't work. i also heard about one for sale in the area but its just a number on the actual car so i have no way of finding it unless i drive all over town looking for that model lol...

they said its purchase price plus $289 processing fee and i figure when i get up there i will be like take off the processing fee b/c its bogus...

thanks JJJ. i posted this on another forum and urs is the only comment that is reassuring at all lol. someone im'd me earlier today and told me they got one with lower mileage for considerably less and it was from a woman that died and her friend sold it and blah blah so now it is making me feel like i'm paying too much or rushing into it since it is higher mileage than i initially was looking at but then again i don't want to pass up a good opportunity which i've done in the past and regretted - don't want to be too impatient either. i'm not going to let the dealer dick around tho, if they want me to pay a 300 dollar processing fee and won't take it off then i'm leaving b/c i'm not going to get screwed over on my first real car purchase (my current car was bought private party in town and was much simpler). i just hope it is in pristine condition like the salesman said and not mediocre so i will be confident i did the right thing.

alpinepower - why'd u ask if the dealership was in VA? that's kinda random! do they have some kind of law or lack of laws protecting the customer or something or have a processing fee?

should i call in or have someone else call in and ask about the car and see if they say its still for sale since its supposed to be on hold or no?

I would wait until this weekend. If the car is meant to be ...then it will still be there. No sense running around faxing cashier checks to dealerships...it will only be used against you when they think you are desperate for the car. Act cool and it may save you a few $'s. There are a ton of used M5's out there for sale...most likely in the same color/mileage/condition.
