      OT: Taxes on replacement car that was stolen

      I have a question about gas guzzler and sales taxes for a replacement car that was stolen approximately one year ago.

      The insurance company's settlement was for less than the full amount. They did not included taxes in their settlement amount. The car was practically brand new, less than 2,000 miles.

      So, I'm going to purchase a replacement vehicle. I've already paid for the gas guzzler tax once. Do I have to pay for it again? Logically, the answer would be yes. However, I was never reimbursed the taxes on my prior vehicle. I'm probably just upset that I didn't get the full amount for my M car.

      Your post/question is somewhat vague. You have a better chance for an answer if you provide further/more detail regarding your situation.

      I went through this exact scenario when my 2000 540i/6 was totaled in an accident in NJ in June 2001. The insurance company (NJ Manufacturers) paid for sales tax and luxury tax but did NOT cover the gas guzzler tax.

      I think you need to go back to the insurance company and request an adjustment to your claim amount. If they refuse, you can talk to the state insurance commission to get clarification on their obligations for covering sales and, if applicable, luxury tax. Given that you and I live in the same state, I think we already know the answer.
