Emissions Situation

So I take the beast to a local gas station for an emissions test and it failed. The tech said the on board diagnostic computer is malfunctioning and not able to connect to his computer. He said he has had several BMW's with the same issue and it's most likely a software glitch that came from the factory that does not recognize any OBD scanner other than dealer equipment. He said he has experienced several that had it covered under warranty. So I called the dealer, they ran my vin and said there are no recalls or tsb's.
They said I would have to bring it in for a possible reflash.

Anyone had the same issue?

Run a search and you should find that there is a TSB for all 2000-2005 BMW M models for this very reason. The government's new software cannot connect with the older BMW ecu software. Hope this helps.

Not sure why the dealer doesn't see you car as needing a programming...maybe done already? Maybe lazy? Maybe they'd rather charge you 2 hours for "reprogramming"

What year is you car anyway?

Is this why he said it's not covered?

"Failure to have this free repair work performed could be determined as lack of proper maintenance of
your vehicle and could jeopardize your full protection under the emissions warranty provisions."

No.

First, did you get a letter? No. So you cannot be held liable for not doing something they never told you.

Second, who knows what the guy looked up. You can ask a dealer service group the same thing on multiple phone calls and get different answers each time...
