Legal advice on purchase of accident-damaged M5 (Delaware)?

if any delaware members are either lawyers or dealership owners, could you PM me i need help to sort out some troubles...

in short:
1. bought car {had a trade in}
2. < 2weeks later tuns out it's been in an accident
3. can the car be return, or can it be replaced with a car of equal value that hasn't been in an accident

What damage was found from the accident? Is there frame damage?

the damage was in the opposite end of the car, the whole time i was worried it had a front end collision, turns out it was rear ended...from the looks of it worse than ocean's M5 was:

If you have a Weak Stomache Please do not Look...Rear Removed

if you look through the rear suspension right above it there's an angled area {part of the chassis}, this area had a "kink" on both sides

looking at the pics ocean put up i think it was these things:

there's one of each on both sides and towards the MIDDLE/FRONT of the rear suspension is where the kink was {i'm assuming it was this part of the chassis as it seems to run through the area i was shown...again i'm real crappy with names so even if the guy from motor works west used the name i forgot it}

how do you know its been in an accident and the extent of the damages???
secondly, to the best of my knowledge theres not much you can do after the fact... 'Caveat emptor'...

when i went to put on a new rim {on Jan/3rd/08} i asked the guys at motor works west to look over the car an see if it's had a previous accident...they found that the car was "rear-ended"...some things where screaming accident, but i could find solid evidence {i thought it was a front end collision not a rear end one}

it may have been both... rear ended into another car in front of them... or something similar...

so did the people who sold you the car give you some type of written guarantee the car was never in an accident? If it was this serious/obvious, why was it not spotted on a pre purchase inspection?

Even on bmw's cpo scheme, a car that has been in an accident is still eligible for cpo status, if the repair was done 'to factory specifications.' Unless you have something that says this car was never wrecked, i'd say you're probably out of luck.

this was the car that had the M5 badge incorrectly applied, right?

From what I understand, I think it wouldve been possible to sort this out had you gotten some sort of written guarantee that the car was never hit. Remeber, for the most part dealers could care less to tell you this or admit to it. Hope things somehow workout- Dave
