Problems with BMW Software Recall- corrupted DME programming an a run around by BMW
So, you will have to excuse me but I am PISSED OFF RIGHT NOW. Called BMW NA about my emisions issue (they re-updated the software to fix the issue) and they said that I am not covered under any CA or Federal warranty since the hardware did not fail only the software. SO, I HAVE TO NOW PAY BMW CONCORD (CA) $500 IN ORDER FOR ME TO GET MY CAR. BMW NA , said that I had to take this up with my state legislature. WTF!!!!!!!!!!!!!!!!!!!!
So, I have but no choice but to pay them so that I can get my car and then fight for a refund. Any thoughts? Do I contact a lawyer?

Why wasn't the emissions software recall/update free for you like it was for everyone else?

so mad you posted it twice?
i dont understand? it was 500 bucks for a software update? thats a joke
and they have to let you know before they do any work...so if you didnt authorize the work to be done for 500 bucks...then you dont have to pay. if you did...sorry thats how it goes.

Not sure what happended with the double post. I think my browser hung and when I hit reload, it posted it twice. Sorry  . But yeah, I authorized them to look at it but I had no choice. How do I get them to determine what the issue is and thus if it falls under emissions warranty if I do not authorize them to do the work? Basically I had NO choice since they are the authorized factory warrant provider and accordoing to the federal emissions laws, that is whom I am suppossed to take it to.

I did have it done by this dealer but they said that this had NOTHING to do with my new computer issue.

Absolutely not.
The Federal Warranty is NOT "hardware only"!
It is the DME, which includes both SW and HW.
Plus, they did the emissions programming within 24 months, correct? There is a 24 month warranty on any work a dealership does.
Don't waste time with the fing legislature.... you need to escalate this at BMW. Call the CARB and get some names, then back to BMW and start telling them how the CARB will be getting involved. Not just spitting out threats, but calmly describing who you spoke to, how they have promised an investigation, they told you the CA warranty is valid, they had other complaints of problems with the BMW recall, etc. You need to move up the BMW ladder.
If you do pay, use AMEX, write on the receipt -signed under duress, then immediately contest the charge. Document it in detail with AMEX- that there was a warranty and this is a warranty claim (leave out all the crap about how they chased shadows)....
Hit them from two sides, but you cn get the car this way

BMW is screwing me regarding emission laws (sorry for 2nd post)
Gonna get car today and good advice. I just submitted a claim to the bureau of automotive repairs and am gonna make some calls. Also going to submit complaint to EPA. Heck, maybe I'll even call the local news station, 7 on your side or make a youtube video
BTW, I am really get soured on this brand.....may have to move to a dealer that handles their customers better.....
And I need to rename this thread, they are not frauds, they just do not care about customers or adhering to CA or Federal emission laws....

Well, they are and if I ever want to drive my car I am gonna have to pay. BMW NA is no help, SA is no help. I need the car to go to work and have already lost consulting income due to not having a car....

There is a letter that they sent every BMW owner. Im sure there are copies of it online, get one, get a rental car, and get a lawyer to take care of it. Or, if you dont feel like making a point, shell out $500 and call the BBB

For me, not worth spending even more money now and letting it sit there and get abused by some tech. Gonna pay it, fight the charges, and make myself the BIGGEST pain the butt to concord bmw and BMW NA. Appreciate all the advice.
