my car might be totaled!!

that's right,
i got rear ended yesterday morning at a red light. the guy that hit was driving a rental BMW X3. he was driving at close to 40KM when he hit me and i was of course stopped for the red light. my whole rear end is now pushed to the right side by about an inch and my trunk lid no longer closes and my bumper is almost touching my right rear tire. i went to my insurance agent to inquire about the damage and how to go about getting it fixed and and he said there is a possibility that my baby might be totaled i am quite sad now

Sorry to hear about your M5
How old is your car ? what mileage & condition.
Is your insurance broker a quallified vehicle engineer ?
If not, his scaremongering opinions would appear to be not helping..
If the the floor has not deformed beyond the rear of the spare wheel recess , there is still hope.
Are the rear quarter panels badly damaged or have the shut gaps on the rear of the doors closed up to the edges of the doors ?
It could still be repaired if these areas are still intact.

When the assessor comes to see the vehicle, make sure you are there & discuss options with him. In the UK , If a vehicle is close to a technical writeoff due to parts & labour cost rather than a buckled floor etc but otherwise in top condition & you make it clear to him that if there is way to get it fixed, you could swing things in your favour.

All may not be lost.

it's a 91 model, has just over 200,000 KM on it. the trunk floor is buckled a little bit but not too badly. the right rear quarter panel is buckled out slightly.
the rear door gap on the left is normal the right is slightly closed and doesn't hinder the door operation. i just came back from the estimator and he said that it looks like close to 5,000 euros damage. i told him i have many reciepts for the work that was done on it in the last year to include the rear SLS shocks. he said this may keep it from being totaled. i should get the final report monday he said.
i really hope my baby isn't totaled

well, from the estimate it is in fact totaled, they gave my car a value of 3,700 euros and and damage totals 5,500 euros. to me the damage is not that bad, i think i can get it fixed for approx 1,500-2,000 euros using tax forms and doing some of the work myself, f i can't i may be looking at a new body and swaping the stuff in or possibly parting it out.

this really sucks

Seems like a very LOW valuation.
Can you find other cars for sale that would contradict their valuation.
That can also work in UK, especially with low production volume cars where market forces can go against our Cap & Glass trade values book.

Worth a try IMHO

Im sorry about your car, but as this was not your fault, perhaps there is a way of getting your insurance company to extract a shortfall from the other parties insurance company if you were to get a valuation from the BMW M owners club of Deutchland. This may make the other insurance company think twice about the writeoff course of action.
