Just a quick update.....finally was able to get a radiator from the stealer.....took nearly 4 weeks....problems between Germany and N.A.....not sure whose fault. In any case, I finally got around to looking at the thermostat...and comparing to the pics Farrell posted in 2008, it's the new style.

This issue resulted in a PUMA technical enquiry iirc.
The measurements were taken in front of BMW workshop staff & the vice dealer principal.
When BMW GB were supplied the dimensional discrepancies between old design & new design as used on S62 & others
(BMW rationalistion) they disregarded the data. The gist was that the numbers of vehicles adversley affected did not justify
a revision.
I have had two warranty claims met by BMW since this time to make a point, but all this really did was cause my local dealership
& main supplier of //M powertrain parts aggravation, which obviously had to be referred to warranty @ BMW GB.
My BMW dealership accept that an issue exists.
Some vehicles may not be affected by the external sealing issue.
Some most definately are.
To have to seal & fill the cooling system to find the housing leaking, is about doing the job twice at my expense.
No, it does not gush out, but it's a small slow weep down the back of the Tstat housing which bugs the hell out of me.

It's a conventional 79 Deg C stat so swapping the seals & body onto a working stat & spring is not the end of the world.

I just visited our local custom to pick up a nice packet sended by Pelican parts.
Order contained among other spare parts a new thermostat (made by Behr) for S38B38.
I somehow understood that design change in part was coupled with change to other thermostat manufacturer?
Should the new Behr thermostat be redesigned version or the "original" one?
