words of advice on speeding ticket anyone?

im due in "court" today because i pleaded not guilty to a speeding ticket in Long Island. i was about 30+ over, which is 4 points here in NY... cop had a laser with a real nice print out, any suggestions to reduce or get rid of these charges?

ticket

I'd play the "upstanding citizen" card. The magistrate or judge hates days like this because, lets face it, speeding tickets are not exactly court TV drama.

In the past I've hired lawyers to do this, and they do it well. They didn't even discuss the particulars of the violation. They did talk about me as a "good student, pillar of the community, family man", etc. (depending on the decade)

a clean record in the past seems to help also.

good luck,

ssomed.

What was the basis of the not guilty plea?

Here in IL, the advice is to go to court, stand before the judge looking all penitent, and plead guilty as charged. Much more often than not you end up getting court supervision for six months with nothing showing up on your record.

Good luck,

Dave

ticket

Best case have it dismissed. Worst case have it reduced; pay fine and no points. Make sure the cop has original paperwork for radar certification, he has to recall the incident from his recollection, not read from his log word for word. Did he ever loose sight of you after he hit you with the gun? was there another cop involved? one to hit you w/gun, another to pull you over?? does the cop have the tuning forks with him for calibration of the gun?? He has to be able to prove you were speeding without a doubt.... I had a 4 point ticket and went to a hearing in Carbon county Pa...the trooper had all the wrong info with him and the judge let it all be admissible because they were friendly w/each other....I was found guilty. i appealed it and the trooper did not show up, the case was dismissed, i even got my check back.... Almost all tickets are beatable or can be reduced....It's all in how you play the game in the courtroom, the judge (and his attitude) the officer... etc. It IS negotiable!!!! at worst case....

Don't admit guilt, say the cop could've radared anyone within the lanes going north and southbound. Say someone was speeding but it surely wasnt you. Burden of proof is on the state, it's great that the cop has a print out but he doesnt have a video of you doing it. Blountly ask for proof of your violation, to prove beyond a reasonable doubt that it is you who commited the act and cross your fingers.

good luck

hi brooklyn m,

you said LASER. that's the catch. radar is a whole different ballgame that you have a better chance of fighting. laser is almost no way out. unfortunately, you might want to get some atty to do it- cost money, but hopefully it is kept off your record or significantly reduced. beats jail and/or insurance rate skyrocketing.

all the best. in a similar boat as you are...
