The dealer has been very forthcoming so far. They admit that the Tech had DSC off and that he lost control because of it.

I can't say much more right now, but I would like to thank my "M5" family for your support and advice. Very much appreciated. I'll keep you posted.....

duh, i saw the previous thread so i modifed my post...

however,

dealers should not crash cars... this will hurt you during resale big time and you are already hurting by installing aftermarket equipment... so this will make things worse.. make them pay somehow...

The dealer is BMW Gallery of Norwood. No airbags deployed. I think we have worked out a fair deal, all of which will be subject to to car being repaired to my standards. I have to tell you that these guys have been very good to work with on this so far. No bullshit and no attitude.

BTW, I borrowed the camera and forgot to check the date!

It's an interesting situation - I've spent the last 13 months getting the car how I wanted it, and I wouldn't do much, if anything different. I also ordered the car the way I wanted it and am very happy with it, including it's now discontinued Silverstone color.

As those of us who have modified their cars know, it takes time and money to get them how you want them. An example is painting the brake calipers, it's only $45 for the kit, but it's a day to get it done. Tinting the windows is a few hundred dollars, but it takes 4 hours and then two days to cure. All that Dinan stuff is expensive and not easily moved to another car. Do I want to start over? Or can I reach a fair deal and keep what I have?

Something to think about!

BTW, The dealer this morning has a new policy on test rides!

I see. But if the dealer have to change his policy after this incident occured, you may wonder how the policy of yesterday was?

Yup, a $$$ deal would be good too, but it has to involve all the time you have to invest in this, time being without / with another car and the lowered value a car get after a crash, esp. an M5. And on top of this add 10% just because this dshould never have happended
