Correction, Problem with EDC not DSC

I got my acronyms mixed up as I was so tired when I posted previously.
According to the owner's manual, EDC remains set to where it was when the car was last turned off.
I've been trying to keep EDC set to the middle setting (one light on).
However, Every time I start the car EDC is back to comfort mode (all lights off) and I have to hit the button again to activate the stiffer setting.
I'd like to just set the EDC and forget about it most of the time.
Has anyone else experienced this?
Do I have a malfunction with the EDC?

I'm trying to find a way to keep the EDC to remain in the same position each time I start the car.
I'm in the break-in period and not currently using the M button, or care to reprogram the M button just for the EDC settings.

I've actually got a different 'problem', but it's with EDC. With my car, I have EDC 'normal' on the "M" setting, and EDC 'comfort' on the non-M setting. If I toggle back and forth between M and non-M the EDC switches as it should. However, if I've driven the car for more than about 10 minutes, the EDC stops switching when I toggle the M button, and remains in 'normal'.

Anyone else have this problem?

That's strange. Mine always comes up in D1, but after using the wheel paddles or the shifter it falls back to S5 which is the one I always use. A friend of mine told me that his M3 CSL falls back to the last most used setting. So if you start using S5 some more, doesn't it start in S5 in stead of S3? Not even sure if you use S3 all the time btw. If not, it doesn't make sense at all. What SW version are you on?
